Thematic takes intellectual property claims very seriously and has adopted the following procedure (“Copyright Policy”), in alignment with the Digital Millennium Copyright Act (DMCA), with respect to intellectual property infringement claims. Thematic is registered with the United States Copyright Office as a Service Provider (refer to the Digital Millennium Copyright Act 17 USC 512). If you believe that your work has been copied in a way that constitutes infringement on our Website, please provide the information requested below. 

How to File a Copyright Infringement Notification

To file a copyright infringement notification with Thematic, you will need to send a written correspondence that specifically includes the following items (please see Section 512(c)(3) of the Digital Millennium Copyright Act to confirm these requirements and the provision of specific information in compliance with DCMA protocol):

  • Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of Work: Identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.  
  • Identification of Infringing Material: Specific identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material. Please provide URLs in the body of your email correspondence to us and include a screenshot of the claimed infringing content so we may locate claimed infringing content quickly.  
  • Contact Information: Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  • Statement of Good Faith: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Statement of Accuracy: A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
All claimants should note that Thematic takes fraudulent copyright claims as seriously as copyright infringement, and advises all claimants to be aware of 17 U.S.C. § 512(f), whereby any person who knowingly materially misrepresents that copyright protected content and material is infringing on their or another’s rights may be subject to liability for damages and we shall aggressively pursue all false claims.

Submission Details

Deficient Notice: DMCA copyright claim notices failing to meet all of the above requirements (including provision of the specific URL and a clear unambiguous description of the claimed infringing content) will be considered "incomplete" and will not be processed.

User Warranties and Repeat Infringers

Please be advised, regardless of how you use our Website and Services, e.g. as a basic user, Artist and/or Creator, you agree, warrant and represent that, all content posted by you on our Website, via our Services, and related platforms, including but not limited to music, audiovisual content, audio content, graphic content, images, software, text, artwork, trademarks and brand identity images utilized by you in any manner, shall not infringe upon the rights of any third parties and shall be free and clear of any third party copyright claims, any breach of this agreement, warranty and representation shall subject you to all legal and equitable remedies available to us.

Further, please be aware that it is our policy to terminate the accounts of proven repeat copyright infringers, as such infringement is a direct breach of these Terms as well as Thematic’s Artist Agreement and Creator Agreement.
